ah you see Terry the difference is that with a cup if you were to fill something it would become full but if you were to empty something it would become empty.
Thus, by filling something to 1/2 it becomes 1/2 full, but by emptying something to 1/2 it becomes 1/2 empty.

it is half full because everything on top of the water is air including everything outside of the cup

because like water is not air and air isnt water and air is above the water so everything else is air except the water at the bottom which makes it half full
